Welcome to ZeriMar Laboratoire. This website and its associated platforms are commercially and legally operated by ZERIMAR S.A.R.L. AU (hereinafter referred to as the “Company”).

By accessing, browsing or using our website, the Plantynia application or any of our services, you (hereinafter referred to as the “User”) expressly, fully and unreservedly agree to be bound by these General Terms and Conditions. If you disagree with any of the clauses set out herein, you must refrain from using our services and leave the platform.

1. Services Offered

Through its web portals and the Plantynia commercial brand, the Company offers the following solutions and content:

  • Professional laboratory microbiological analysis services.

  • Online consultancy and advisory services specializing in plant pathology.

  • Online training courses and the issuance of certifications attesting to technical skills.

  • Sale of digital products (guides, manuals, technical protocols, agricultural engineering spreadsheets and specialized images in TIF format).

  • Monthly or annual subscription plans providing access to exclusive content and advanced tools.

  • Public and private tools, such as the Plantynia application, online plant health diagnostics, digital field notebook, dynamic pest maps and automated plant protection product calculator.

2. Registration Requirements and User Accounts

Access to certain premium features, online courses, the personal account area and the ecosystem of tools within the Plantynia application requires the prior creation of a user account.

  • The User agrees to provide truthful, accurate and up-to-date information during the registration process.

  • The account is personal and non-transferable. The User is solely responsible for safeguarding the confidentiality of their login credentials.

  • There are no age or geographical location restrictions for general registration. However, compliance with regulations governing the use of agricultural inputs shall depend strictly on the territory in which the User is located.

3. Financial Terms, Payments and No-Refund Policy

All commercial transactions, payment processing and invoicing are centrally managed under the legal ownership of ZERIMAR S.A.R.L. AU. By purchasing a product or service on our platform, the User expressly consents to authorized payment gateways (such as Paymentwall) processing the charge under the identifiers of the Company or its commercial brand.

Due to the digital nature and immediate availability of our solutions, the following strict financial policy applies:

  • Instant Download Products: The sale of guides, manuals, protocols, spreadsheets and high-resolution TIF images is completed immediately. Since access to the original file is granted instantly, no returns or refunds will be accepted under any circumstances.

  • Online Courses and Certifications: Access to the virtual classroom, educational materials and complete course content is granted in full once payment has been validated. Consequently, no refunds are offered once registration has been completed.

  • Plant Pathology Consultations: Online advisory services are non-refundable. Cancellations or failure to attend by the User with less than 24 hours’ notice shall not entitle the User to a refund or rescheduling of the appointment.

  • Recurring Subscriptions: Monthly or annual subscriptions do not entitle the User to partial or full refunds for periods that have already been billed. The User retains the right to cancel the renewal of their subscription at any time; cancellation will take effect at the end of the current billing period.

 

4. Intellectual and Industrial Property

All content hosted, structured or distributed on this website and within the Plantynia application (including, but not limited to, texts, software code, calculation algorithms, TIF images, pest databases, field guides, manuals, logos, interfaces, multimedia course materials and trademarks) is the exclusive property of ZERIMAR S.A.R.L. AU or is used under the corresponding licenses.

Any reproduction, distribution, public communication, transformation, resale or commercial exploitation of these materials without the prior, express and written authorization of the Company's management is strictly prohibited.

5. Third-Party Links, Advertising and Affiliate Marketing

Our platforms may include hyperlinks to third-party resources, tools or websites for purely informational purposes. The website may also contain advertisements managed by external networks (such as Google AdSense) and commercial affiliate links (for example, Amazon).

The Company exercises no technical or editorial control over such external portals and therefore accepts no responsibility for their content, privacy policies, commercial transactions or any damages arising from browsing third-party platforms.

6. Limitation of Technical Liability

The Company makes every commercial and technological effort to keep the website operational and free from errors. However, it does not guarantee uninterrupted availability, the absence of technical failures on its servers or the absolute infallibility of the application's algorithms. The Company shall be exempt from any liability for direct or indirect damages, loss of profits, data loss or business interruption resulting from the use of, or inability to use, our digital platforms.

7. Restrictions on Use and Agronomic Disclaimer

The User undertakes to use the services and information in accordance with the law, morality and public order. In particular, the following conditions apply:

  • Use of Plant Protection Products: The Company accepts no responsibility for the acquisition, handling, dosage or improper use of plant protection products or chemical substances by the User.

  • Advisory Nature: All information provided by the digital tools of the Plantynia application, automated online diagnostics and agronomic calculators constitutes guidance and recommendations for informational purposes only. These technical guidelines shall under no circumstances replace, modify or invalidate the regulations, legal requirements or official manufacturers' instructions in force in the User's local or international region.

  • Prohibition of Commercialization: The copying, reproduction, in whole or in part, or resale of any of our digital products or training course materials without an explicit license is strictly prohibited.

8. Prohibition of Data Extraction (Anti-Scraping) and API Use

The use of any automated data extraction technique is expressly prohibited, including, but not limited to, web scraping, crawling, data mining, or the use of web robots and spiders to index, collect or copy structured information from our servers.

Likewise, the use of integration structures such as iframes to externally replicate the platform's interface or content is prohibited. The User is strictly prohibited from accessing, interacting with or manipulating the website's internal Application Programming Interfaces (APIs) without authorization for the purpose of extracting, decompiling, modifying or distributing source code or data. Any breach of this clause shall result in the immediate revocation of access, the technical blocking of the infringer's IP infrastructure and the initiation of the relevant legal proceedings.

9. Applicable Law and Competent Jurisdiction

These General Terms and Conditions shall be governed by and interpreted in strict accordance with the laws in force in the Kingdom of Morocco, including regulations on electronic commerce and data protection. For the resolution of any controversy, litigation, legal dispute or claim arising from the interpretation or performance of this agreement, both parties voluntarily submit, expressly waiving any other jurisdiction that may otherwise apply to them, to the exclusive jurisdiction of the courts and tribunals of the city of Tangier, Morocco.

10. Amendments to the Terms and Conditions

The Company reserves the exclusive right to modify, update or reformulate these General Terms and Conditions at any time and without prior notice, in order to adapt them to legislative developments or the requirements of international payment processors. The User is responsible for reviewing this document periodically to remain informed of the applicable terms and conditions.
